1. Acknowledgment of Risk
I, the undersigned visitor, understand that by entering and using the grounds of On The Way Acres, I am visiting a rural and natural environment that may include uneven terrain, wooded areas, open fields, trails, ponds, wildlife, insects, and other natural or man-made features.
I acknowledge that activities such as walking, hiking, exploring, or participating in recreational or agricultural activities on this property involve inherent risks, including but not limited to:
- Slips, trips, or falls on uneven or slippery ground
- Encounters with wildlife or domestic animals
- Exposure to weather and environmental hazards
- Contact with insects, including ticks, which may transmit Lyme disease or other illnesses
- Potential allergic reactions to plants, pollen, or insect bites
I voluntarily assume all risks of injury, illness, or harm that may occur while on the property, whether known or unknown.
2. Release of Liability
In consideration for being permitted to access and use the property, I hereby waive, release, and discharge the owners, operators, employees, and volunteers of On The Way Acres, their heirs, successors, and assigns from any and all claims, demands, or causes of action arising out of or connected to my visit, including those caused by negligence, except in cases of gross negligence or willful misconduct.
3. Personal Responsibility
I agree to:
- Stay within permitted areas and respect all posted signs.
- Supervise any minors or guests in my care.
- Wear appropriate footwear and clothing for outdoor conditions.
- Take reasonable precautions against ticks, including using repellents and checking for ticks after leaving the property.
- Report any unsafe conditions to the property owner immediately.
4. Medical Treatment
In the event of illness or injury, I authorize On The Way Acres or its representatives to obtain emergency medical assistance as deemed necessary, and I agree to assume full financial responsibility for any related costs.
5. Media Release and Consent
Permission is hereby granted to the farm and its representatives the irrevocable right to take, use, and publish photographs or videos taken during the visit. It is understood that these materials may be used for any lawful purpose, including but not limited to social media, website content, and future advertising or promotional materials. Any right to inspect or approve the finished product is waived, and it is agreed that no financial compensation will be provided for the use of such media.
6. Binding Effect
This waiver is binding upon myself, my heirs, executors, administrators, and assigns. I understand that I am giving up certain legal rights, including the right to sue for injuries or damages arising from my visit.
7. Severability
If any part of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
8. Signature
By signing below, I acknowledge that I have read and fully understand this Waiver and Assumption of Risk Agreement, and that I am signing it voluntarily.
